Acceptable Use Policy

INTRODUCTION

iAM Creative Network ("Company", "we", “us”) respects its members and website users (“you”, “user”, “member”), and is committed to creating a respectful member community by complying with this policy.

This Acceptable Use Policy (“Policy”) establishes the acceptable use requirements for iAM Creative Network products and services, primarily the technology infrastructure used to provide such products and services to its members (“member network”). For the purpose of this Policy, technology includes, but is not limited to, the iAM Creative Network member network, email and instant messaging. 

iAM Creative Network adopts a philosophy of self-regulation and users must, at all times, hold themselves to the highest standards of conduct, including but not limited to interactions within the member network. You are responsible for actions taken when connected to the member network including connection with other people through the use of instant messaging within the member network.

ACCEPTABLE USE

Users are permitted to use the products and services of iAM Creative Network solely for the purposes authorized in the applicable agreement under which iAM Creative Network provides you with such products and services. 

INAPPROPRIATE AND UNACCEPTABLE USES

Users must not use the products or services made available by iAM Creative Network in any manner that constitutes an inappropriate or unacceptable use, including:

  • Solicitation, recruitment or advertisement for any commercial ventures, religious or political causes, outside organizations or other solicitations;

  • To store, access, transfer, download, upload, communicate or create any fraudulent, harassing, embarrassing, sexually explicit, profane, obscene, intimidating, libelous, slanderous, threatening, abusive, defamatory, or otherwise unlawful or inappropriate materials;

  • To post or transmit proprietary or confidential information related to members, suppliers, vendors, allied parties, or other third parties;

  • To post or store Company business-related information on public storage sites;

  • The use of iAM Creative Network resources in a manner that violates applicable laws, including without limitation, those laws relating to discrimination and harassment, privacy, financial disclosure, intellectual property and proprietary information, defamation and criminal laws;

  • The download or distribution of pirated software or data;

  • The deliberate propagation of a virus, malware, or any other malicious program code;

  • Sending confidential Company information without prior authorization from the Company. Such confidential information includes, but is not limited to, Company copyrighted materials, trade secrets, intellectual property, proprietary financial information, employee information, customer information, or other similar materials that would be considered confidential in nature (“Confidential Information”);

  • The access, use or disclosure of Confidential Information without authority;

  • The creation, collection, transmission, storage or exchange of any material in violation of applicable laws;

  • Accessing, using, collecting, destroying, encrypting, altering or disposing of information in violation of any applicable laws;

  • Making, possessing or distributing computer programs that are designed to assist in obtaining access to computer systems in violation of applicable laws;

  • Promoting hatred against any identifiable group or individual by communicating such statements in violation of applicable laws;

  • Harassing other persons electronically (e.g. making threats to a person’s safety or property);

  • Possessing, viewing, downloading, transmitting or storing any pornography, or any involvement whatsoever with the traffic of such material;

  • Using another user’s credentials to engage in any activity in violation of applicable laws;

  • Wilfully bypassing or subverting any physical, logical or procedural safeguards used by iAM Creative Network or any other person, such as firewalls, web-filtering software or other access controls;

  • Vandalism, which is defined as any malicious attempt to harm or destroy the information of another user, the Internet or other networks;

  • Harassment, including persistent non-member related contact with another person when such contact is unwelcome or may be deemed to create a poisoned member environment by accessing, displaying, storing, downloading or transmitting any content which is offensive;

  • Sending anonymous messages or impersonating any other person;

  • Selling, sharing or otherwise redistributing iAM Creative Network products or services without written authorization from iAM Creative Network, and

  • Any other activity that may expose iAM Creative Network to liability.

BREACHES AND INVESTIGATIONS

Any and all breaches of this Policy will be treated with the utmost seriousness by the Company.

All Users must comply with this Policy at all times and take care to ensure that their use of the iAM Creative Network member network does not jeopardize the interests of the Company, personal information in its custody or control, or its Confidential Information.

Although iAM Creative Network is not obligated to monitor content, and assumes no responsibility for any information or material that is transmitted by users of the products and services made available by iAM Creative Network, or the Internet. iAM Creative Network reserves the right, subject to all applicable laws relating to the protection of personal information, to investigate content posted to or transmitted over its member network, and may block access to, refuse to post, or remove any information or material that it deems to be in breach of this policy.

There are four levels of response to violations of the Acceptable Use Policy that the Company may take: 

  1. Issue warnings: written or verbal

  2. Suspend the Member's account

  3. Terminate the Member's account

  4. Bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

Users must notify the Company of any suspected breach of this Policy by email to admin@iamcreativenetwork.com.  If a member is reported by another member, if content that appears in the network is flagged as reported by a member, or if a piece of content is reported by two or more members, iAM Creative Network may remove members from the community immediately and without prior notice. 

iAM Creative Network reserves the right to investigate suspected breaches of this policy, and asks that all users cooperate when asked to assist in any such investigation. If the Company investigates a reasonably suspected breach of this Policy, the investigation is completed promptly and impartially, including but not limited to:

  • In the course of an investigation, the Company may require a written statement from the User involved in or with knowledge of the suspected breach, as well as an interview of any person with knowledge of the incident, and collect any and all relevant and material documents and other evidence. 

  • The Company may involve investigators and experts where appropriate to investigate and report to the Company.

  • A User may, in the Company's sole discretion, be suspended while an investigation is undertaken and completed.

  • Confidentiality will be maintained through the investigation process to the extent practicable and appropriate in the circumstances. 

  • Information obtained in connection with this Policy, including identifying information about any individuals involved, will not be disclosed unless the disclosure is necessary for the purposes of investigating or taking corrective action with respect to the incident, or as otherwise required by law. However, the Company may disclose certain information to the affected parties to gather pertinent facts or answer allegations.

  • All Users are expected to cooperate fully in any investigation pursuant to this Policy. If, after investigation, the Company finds that a violation of this Policy has occurred, the Company will determine what remedial action should be taken to avoid future incidents and to ensure compliance with this Policy in the future. Any such remedial action will be undertaken in accordance with this Policy.

SECURITY

The Company reserves the right to implement controls at any time in its sole discretion where it is deemed necessary to protect the security of the member network, Confidential Information, personal information or other assets. Users may not block, uninstall or otherwise interfere with such controls.

Users must maintain basic controls to prevent potential security breaches and leaking of Confidential Information or personal information.

Users must maintain confidentiality and exclusive control of authentication credentials (passwords, tokens, certificates) used to access the member network. Credentials must not be shared with others at any time or left in a place where an unauthorized person might find them. If a User has reason to believe that his/her password has been compromised or discovered by another person, the User must change his/her password immediately. Other basic controls include, but are not limited to:

  • Ensuring that laptops, mobile devices and desktop computers are protected by lock screen passwords and that screens are set to lock within 10 minutes of inactivity; 

  • Changing passwords not less than every 30 days. The same password cannot be used more than once every 24 passwords;

  • Keeping laptops, mobile devices and portable storage devices and media appropriately secured (e.g. not leaving these items unattended in a vehicle or public place);

  • Preventing unauthorized changes being made to the operating system software or configuration of personal computers or mobile devices used to access Company Technology; and

  • Not sharing mobile devices used to access Company Technology, or portable media containing Confidential Information or assets, with third parties (including family members);

Users must exercise caution when opening attachments or selecting links (these can be contained in electronic messages, blogs or social networks) from unknown sources as these may contain malicious software (also known as malware, examples include viruses, worms and trojans).

The Company reserves the right to revoke access to or use of any or all of the member network at any time in its sole discretion. Access to member network may be revoked when a User ends their membership.

CHANGES TO OUR ACCEPTABLE USE POLICY

It is our policy to post any changes we make to our acceptable use policy on this page. If we make material changes to this policy, we will notify you by email to the email address specified in your account.

We include the date the acceptable use policy was last revised at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting our Website and this acceptable use policy to check for any changes.
